general terms and conditions.

This is a courtesy translation. The Czech version of these terms and conditions is legally binding; in case of any discrepancy, the Czech text prevails.

These general terms and conditions govern the booking and provision of short-term accommodation in the Chata HRA property and the related rights and obligations between the operator and the customer.

1. operator and property.

The accommodation services are operated by:

2. basic provisions.

These terms and conditions apply to all bookings of a stay in the Chata HRA property.

By submitting a booking, paying for a stay or otherwise confirming a booking, the customer confirms that they have become familiar with these terms and conditions and agree to them.

The accommodation contract arises upon the operator's confirmation of the booking and the fulfilment of the payment terms stated for the specific booking.

3. booking a stay.

A stay is booked through the booking system, the website, email communication or another booking channel enabled by the operator.

When booking, the customer states in particular the dates of the stay, the number of guests and contact details. The customer is obliged to provide truthful, complete and current information.

A booking is binding at the moment the full price of the stay is paid, unless stated otherwise for the specific booking.

After payment, the customer receives a booking confirmation by email.

Arrival information, property instructions and other guidance for the stay are sent to the customer by email before the start of the stay.

4. price and payment terms.

The price of the stay is stated in the booking process, in a price offer or in the booking confirmation.

Prices include the applicable taxes and fees, unless expressly stated otherwise.

The local accommodation fee may be included in the price of the stay or charged separately according to the rules of the relevant municipality. If it is charged separately, the customer is informed of this before confirming the booking or in the arrival instructions.

The stay is paid in full in advance, unless stated otherwise for the specific booking.

Payment is made in the manner stated in the booking process or in the booking confirmation.

A booking is confirmed only after the full price of the stay has been paid, unless agreed otherwise. If payment is not made properly and on time, the operator is not obliged to hold the dates for the customer.

5. changing a booking.

The customer may request a one-off change to the dates of the stay if they request the change more than 7 days before the planned arrival.

A change of dates is possible only subject to the current availability of the Chata HRA property and after confirmation by the operator.

If the new dates are more expensive than the original booking, the customer pays the difference in price.

There is no automatic entitlement to a change of dates. Where operationally possible, the operator will try to accommodate the customer.

6. cancellation terms.

The customer may cancel a booking by email at rezervace@chatahra.cz.

The cancellation terms are as follows:

  • for cancellation more than 30 days before the planned arrival, cancellation is free of charge,
  • for cancellation 30 to 15 days before the planned arrival, the cancellation fee is 50 % of the price of the stay,
  • for cancellation less than 15 days before the planned arrival, the cancellation fee is 100 % of the price of the stay,
  • for a no-show without prior notice, the cancellation fee is 100 % of the price of the stay.

The decisive moment is when the request to cancel the booking is delivered to the operator.

7. check-in and check-out.

Check-in is possible from 3:00 p.m. on the day of arrival.

Check-out must be completed no later than 10:00 a.m. on the day of departure.

An earlier arrival or later departure is possible only by prior arrangement and confirmation by the operator.

The customer is obliged to observe the departure time so that the property can be prepared for the next guests.

8. capacity of the stay.

The maximum capacity of the Chata HRA property is stated in the booking, in the booking system or in the arrival information.

Without the operator's prior consent, the customer may not exceed the maximum capacity of the property or allow persons not listed in the booking to stay overnight.

The customer is responsible for all persons whom they allow to enter the property or the land during the stay.

9. no pets.

A stay with animals is not permitted in the Chata HRA property.

The prohibition applies to all animals, unless an exception is confirmed in advance in writing by the operator.

A breach of this prohibition may be considered a breach of the terms of the stay. In such a case the operator is entitled to claim compensation for the actual damage incurred, the costs of extraordinary cleaning, cleaning of textiles or restoring the property to its original condition.

10. deposit and liability for damage.

The operator does not normally collect a deposit, unless stated otherwise for the specific booking.

The customer is liable for damage caused to the Chata HRA property, its equipment, furnishings, textiles, hot tub, sauna, swing, pull-up bar, land or other property of the operator.

The customer is obliged to notify the operator without undue delay of any damage, fault or extraordinary event that occurs during the stay.

The operator is entitled to claim full compensation for the actual damage incurred.

11. operating rules of the stay.

The customer is obliged to use the Chata HRA property, its equipment and the land carefully, safely and in accordance with the operator's instructions.

The customer undertakes in particular to:

  • not smoke inside the property,
  • not hold parties, celebrations or noisy events without the operator's prior consent,
  • observe quiet hours and respect the surroundings,
  • not admit further unregistered persons into the property for overnight stays,
  • not interfere with the property's technical equipment,
  • follow the arrival instructions and the guidance provided at the property,
  • before departure, switch off the lights, close the windows and doors, and leave the property in a reasonable state.

The customer acknowledges that the property is located in a natural environment. The surroundings may feature common natural phenomena, for example uneven terrain, insects, mud, snow, ice or other conditions corresponding to a stay in nature. The customer is obliged to adapt their behaviour and movement around the land accordingly.

12. safety rules for the property's equipment.

The Chata HRA property includes a hot tub, a sauna, a swing and a pull-up bar.

The customer and other guests use this equipment at their own risk and are obliged to observe the operator's instructions, the guidance provided at the property and the rules for safe use.

The hot tub, sauna, swing and pull-up bar may not be used under a significant influence of alcohol or narcotic or psychotropic substances.

The customer is obliged to consider their state of health before using the hot tub or sauna. If they have doubts about the suitability of using them given their state of health, they must not use the equipment.

Children may use the hot tub, sauna, swing and pull-up bar only under the constant supervision of a responsible adult.

It is prohibited to:

  • interfere with the technical equipment of the hot tub or sauna,
  • change the equipment settings contrary to the instructions,
  • use the equipment for anything other than its intended purpose,
  • use damaged equipment,
  • overload the swing or pull-up bar,
  • leave children unsupervised while using the equipment.

The customer is obliged to report any fault, damage or abnormal behaviour of the equipment to the operator immediately and not to use the equipment until the fault is resolved.

The customer is liable for damage caused by incorrect, unsafe or unauthorised use of the equipment.

13. statutory registration of accommodated persons.

The customer is obliged to provide the operator with true and complete data required for the statutory registration of accommodated persons, any local accommodation fee and the fulfilment of the operator's other statutory obligations.

In the case of accommodating a foreign national, the customer is obliged to provide the data needed to fulfil the accommodation provider's obligations towards the Police of the Czech Republic.

If the customer refuses to provide data necessary to fulfil the accommodation provider's statutory obligations, the operator may refuse to provide the stay.

14. complaints.

If the customer discovers any fault, problem or shortcoming during the stay, they are obliged to inform the operator without undue delay so that the situation can be resolved during the stay.

Complaints may be sent to the email address rezervace@chatahra.cz.

A complaint should contain the customer's identification, the dates of the stay, the designation of the property, a description of the matter complained of, and, where applicable, photographs or other supporting materials.

The operator will handle the complaint without undue delay, no later than 30 days from its receipt, unless it agrees otherwise with the customer.

15. limitation of the operator's liability.

The operator is not liable for damage caused by the customer, other guests, third parties, force majeure, unsuitable use of equipment, breach of the operating rules or failure to follow the operator's instructions.

The operator is not liable for a reduction in comfort caused by common natural conditions, the weather, the presence of insects, seasonal influences, outages of third-party services or circumstances beyond its control.

If an extraordinary situation makes it impossible to provide the stay, for example an accident, an outage of essential services, an event of force majeure or another serious operational obstacle, the operator will offer the customer alternative dates, another suitable solution or a refund of the corresponding part of the price according to the nature of the situation.

16. personal data protection.

The operator processes customers' personal data in accordance with applicable legal regulations.

Personal data is processed in particular for the purpose of creating and administering the booking, providing the stay, communicating with the customer, fulfilling the accounting, tax and statutory obligations of the accommodation provider, resolving complaints and any claims for damages.

Details of the processing of personal data are set out in a separate privacy policy published on the operator's website, where published.

17. out-of-court resolution of consumer disputes.

If the customer is a consumer and a dispute arises between the customer and the operator out of the contract that cannot be resolved by mutual agreement, the customer may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce) as the competent body for the out-of-court resolution of consumer disputes.

18. final provisions.

These terms and conditions are governed by the law of the Czech Republic.

If any provision of these terms proves invalid or ineffective, this does not affect the validity of the other provisions.

The operator is entitled to amend these terms and conditions. For a specific booking, the version of the terms and conditions in effect at the time the booking is made applies.

These terms and conditions are available to the customer before making a booking.
